The 36-year-old sued the Victorian government in July for false imprisonment.
The District Court of Victoria ruled that two of the three arrests were unlawful as the government had failed to establish the elements required for summary arrest under section 458 of the Crimes Act in these cases.
Ms. Smit spent 22 days in detention for allegedly inciting others to participate in the 2021 protests. This charge was eventually dropped and she was later found guilty without conviction of breaching Covid orders.”
Ms. Smit was awarded $4,000 in damages after two of her three lawsuits were successful.
“We had a fair hearing, but I don't think it's fair,” she said.
“Do you think it's fair for someone to win their case and then have a AUD 200,000 costs award against them?
I don't think people know that happens, I don't think people know that's the risk people take to go up against the authorities - and now they're going to find out.”
